KYC Enhanced Due Diligence for Dual Use Goods Suppliers.

Dual-use goods are items, software or technology that can be used for both civil and military purposes. From a UK/EU perspective, exporters are responsible for checking whether their goods are controlled, whether an export licence is required, and whether there are concerns about the intended end-user, destination or end-use. Other jurisdictions have similiar frameworks & regulations to ensure that civilian products are not diverted for military warfare.

Enhanced due diligence is the deeper review carried out when a relationship, transaction, subject or entity presents higher risk. It helps identify diversion risks, sanctions exposure, weapons of mass destruction concerns, military end-use risks, human rights risks and other indicators that goods may be misused or re-exported contrary to law.

Furthermore. there is often a cross over between dual use goods and sanctioned entities, subjects, regimes and entities, in that they are often symbiotic and use similar techniques, structures and methods to avoid detection.

When Enhanced Due Diligence is Needed:

  • The item appears on an applicable national, regional or multilateral control list, or may fall within a dual-use control category.

  • The transaction may involve export, re-export, transfer, transit, brokering, technical assistance or intangible transfer of technology controls.

  • The customer, consignee, end-user, destination or route is unusual for the stated business purpose.

  • The end-use is unclear, inconsistent or sensitive, including military, nuclear, chemical, biological, missile, surveillance, cyber, artificial intelligence, semiconductor or advanced technology applications.

  • The transaction involves sanctions, embargoes, a high-risk jurisdiction, a complex intermediary chain or a party that is reluctant to provide information.

  • The exporter, supplier, financier, logistics provider or platform has been informed of concerns, or has its own concerns, about the intended end-use or end-user.
